Terms of service

1. The service

Sonrisario is management software as a service (SaaS) for dental practices: clinical records, dental chart, estimates, invoicing, scheduling and analytics modules, operated by Dajeury Velez Lima (Dominican Republic), who acts as processor of the data hosted in the service. By creating a practice you accept these terms on behalf of your organization, and you represent that you have authority to do so.

Electronic acceptance. These terms are accepted electronically when you create the practice. The parties expressly agree that this act —ticking the acceptance box and completing registration— constitutes the identification method agreed between them, and that the record we keep of that acceptance —who accepted, which version, and when— is sufficient evidence of it, under Dominican Law 126-02 on Electronic Commerce, Documents and Digital Signatures and its regulations. Neither party will challenge the validity of this agreement solely because it was entered into electronically.

2. The practice’s responsibilities

  • Clinical content (diagnoses, treatments, notes, consents) is the exclusive responsibility of the practice’s healthcare staff.
  • The practice is responsible for obtaining its patients’ consent for the processing of their data and for using secure credentials for its team.
  • Fiscal receipts (NCF/e-CF) are issued using the authorized ranges the practice configures; keeping them current with the DGII is the practice’s responsibility.

3. Subscription and payments

The service is contracted as a monthly subscription per practice, in US$ (automatic recurring billing via Polar); RD$ payment by local card (per period, with manual renewal) will be available once that gateway is enabled. The first month is billed at a promotional price. RD$ prices include ITBIS. Each plan includes a number of doctors; additional doctors are billed monthly at the rate published on the pricing page. If a renewal is not completed, after a grace period the account enters view-only mode: the team keeps read access to records, the schedule and the export of all data, and full operation resumes upon reactivating payment. Access to clinical data is never blocked.

Metered add-on services. Beyond the plan fee, some services are billed by usage:

  • Electronic fiscal receipts (e-CF). Applies only to practices issuing in e-CF mode. The monthly allowance is fifty (50) receipts per doctor: it counts both the doctors your plan includes and any additional doctors you contract, since their monthly fee also covers their allowance. Receipts beyond it are billed at the unit price published on the pricing page, at the close of the month in which they were used and in your subscription currency. The allowance does not roll over: it resets every month and unused receipts are not carried forward. You will see your practice's exact allowance when configuring e-CF mode.
  • AI assistant. An optional service contracted separately from the plan, at the rate published on the pricing page. Its use is subject to fair-use limits per practice, published in the platform; on reaching them the assistant stops answering until the next period, without affecting any other feature.
  • Additional doctors. Each plan includes a number of doctors; those beyond that number are billed monthly at the published rate.

Current prices and allowances are always those published on the pricing page, and may change over time. If we change prices, your practice continues on the plan and price it currently has, unless we tell you otherwise in writing — in which case the new price applies from the following period and never to one already paid for.

4. Your data is yours

The data you record belongs to the practice. You can export it in standard formats. Upon termination of the service, we offer a reasonable window to export and we keep only what health and tax regulations require.

5. Availability and support

We run on first-tier cloud infrastructure and make periodic backups. The service is provided "as is"; we will make commercially reasonable efforts to keep availability high and announce maintenance in advance. For support, write to us at soporte@sonrisario.com: we operate on business days and reply within 24–48 business hours. The platform also includes a help center with a manual and guides, and an assistant that answers usage questions.

6. Acceptable use

You may not use the platform for unlawful purposes, attempt to access other practices’ data, resell the service or deliberately overload the infrastructure. Violations may result in account suspension.

7. Territorial scope and compliance

The platform’s fiscal and regulatory compliance features (NCF, e-CF, DGII, record retention, Law 172-13) are designed for the Dominican Republic. If your practice operates in another country, you are responsible for verifying and complying with the applicable local regulations; the platform does not guarantee legal conformity outside the Dominican Republic.

8. Customer mention

We may mention your practice's name and logo in our customer list, on the website and in commercial materials, for the sole purpose of indicating that you use the platform. You may ask us in writing at soporte@sonrisario.com to stop at any time, and we will remove it from our materials within a reasonable period. We will never publish your patients' data, your revenue figures, or information you have marked as confidential. Any testimonial, case study or interview is agreed separately and requires your specific authorization; using photographs or videos of identifiable people also requires those people's consent.

9. Changes and assignment

These terms may change over time. Each version carries its date, and when a change materially affects how your data is processed or what you pay we will notify you by email at the account owner's address. Continuing to use the service after that notice constitutes acceptance of the changes; if you disagree, you may cancel at any time from Subscription and you keep the service until the end of the period already paid for. The service is currently operated by a natural person; we may assign this agreement and the service relationship to the company we incorporate to operate Sonrisario, or as part of a corporate reorganization, by notifying you in writing and without reducing your rights or changing your commercial terms.

10. Governing law

These terms are governed by the laws of the Dominican Republic. Any dispute will be submitted to the courts of Santo Domingo.
